Terms of Service

These Terms of Service ("Terms") govern your access to and use of ArtBoost AI, operated by Will's Custom Airbrushing LLC ("ArtBoost AI," "we," "us," or "our"), including our website, mobile applications, AI marketing tools, content-generation tools, scheduling and publishing features, store integrations, social-media integrations, and related services (collectively, the "Services"). By creating an account or using the Services, you agree to these Terms.
1. Eligibility and Accounts
You must be legally capable of entering into these Terms and meet the minimum age required by applicable law and any connected platform. You agree to provide accurate account information, keep credentials secure, and promptly notify us of suspected unauthorized use. You are responsible for activity performed through your account except to the extent caused by ArtBoost AI's breach of applicable obligations.
2. The ArtBoost AI Service
ArtBoost AI provides tools that may help users organize products and artwork, generate marketing material, create media, connect supported stores and social accounts, schedule content, publish content, review available analytics, and receive AI-assisted marketing guidance. Features, integrations, limits, and availability may vary by plan, platform, region, API access, and third-party requirements.
3. Connected Accounts and Authorization
You may choose to connect supported third-party accounts, including social-media and commerce services. By connecting an account and initiating or scheduling an action, you authorize ArtBoost AI to use the permissions granted by you to perform that action on your behalf. You represent that you are authorized to connect and use each account. You remain responsible for complying with the terms, policies, community guidelines, intellectual-property rules, and advertising or commerce requirements of each connected service.
You may revoke a connection through ArtBoost AI or the applicable third-party service. Revocation may disable features that depend on that connection.
4. User Content and Intellectual Property
You retain ownership of artwork, images, text, videos, product information, and other content that you own and submit to ArtBoost AI ("User Content"). You grant ArtBoost AI a limited, non-exclusive license to host, copy, process, transform, transmit, display, and otherwise use User Content only as reasonably necessary to provide, secure, support, and improve the Services and to perform actions you request. You represent that you have the rights and permissions necessary for User Content and for any requested publication or use.
ArtBoost AI and its software, branding, interfaces, documentation, and original service materials are protected by applicable intellectual-property laws. Except for rights expressly granted in these Terms, no rights in ArtBoost AI's intellectual property are transferred to you.
5. AI-Generated Content
AI-generated suggestions and media can contain errors, similarities to other material, or unsuitable results. You are responsible for reviewing generated output before publishing or relying on it, including checking accuracy, intellectual-property rights, platform rules, disclosures, and suitability for your audience. ArtBoost AI does not guarantee that AI-generated output is unique, error-free, non-infringing, or appropriate for every use.
6. Acceptable Use
You may not use the Services to violate law; infringe intellectual-property, privacy, publicity, or other rights; distribute malware or harmful code; deceive, impersonate, defraud, harass, or exploit others; bypass security, rate limits, subscription limits, or access controls; scrape or access third-party services in an unauthorized manner; interfere with service operation; publish spam or prohibited content; or use an integration in violation of the applicable third party's rules. We may restrict activity that creates security, legal, platform-compliance, or operational risk.
7. Scheduling and Publishing
You control the content and destinations you select. Scheduling and publishing depend on third-party APIs, authentication, account status, rate limits, moderation, network availability, and other systems outside our control. A scheduled or attempted post is not a guarantee that a third-party platform will accept, publish, retain, or distribute the content. You should review publishing status and any reported errors.
8. Subscriptions, Billing, and Usage Limits
Paid features may require a recurring subscription. Prices, included usage, plan features, and billing frequency are presented before purchase. Unless otherwise stated at purchase or required by law, subscriptions renew automatically until canceled. You may cancel through the available billing controls; cancellation ordinarily prevents future renewal while access continues through the paid period. Fees already incurred are non-refundable except where required by law or expressly stated otherwise. Taxes may apply. Certain resource-intensive features may have usage, storage, generation, or platform limits to protect service reliability and manage third-party costs.
9. Third-Party Services
The Services rely on or interoperate with independent third parties. We do not control third-party platforms and cannot guarantee their availability, API behavior, moderation decisions, account actions, policies, or continued support for an integration. Third-party changes may require ArtBoost AI to modify, suspend, or discontinue affected functionality.
10. Privacy
Our Privacy Policy explains how we collect, use, disclose, retain, and protect information and is incorporated into these Terms by reference.
11. Suspension and Termination
You may stop using the Services at any time. We may suspend or terminate access when reasonably necessary for nonpayment, material breach of these Terms, fraud, abuse, security risk, legal requirements, third-party platform requirements, or conduct that threatens users or the Services. Where appropriate, we may provide notice or an opportunity to remedy an issue.
12. Service Changes and Availability
We may update, add, remove, or modify features to maintain security, comply with law or third-party requirements, improve performance, or develop the Services. We do not guarantee uninterrupted or error-free availability. Planned or emergency maintenance and third-party outages may affect access.
13. Disclaimers
To the maximum extent permitted by law, the Services are provided "as is" and "as available." ArtBoost AI disclaims warranties not expressly provided in these Terms, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. ArtBoost AI does not guarantee marketing results, sales, follower growth, engagement, revenue, platform approval, or continued availability of any third-party integration.
14. Limitation of Liability
To the maximum extent permitted by applicable law, ArtBoost AI and its owners, affiliates, officers, employees, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunities arising from or related to the Services. To the maximum extent permitted by law, our aggregate liability for claims relating to the Services will not exceed the amount you paid to ArtBoost AI for the Services during the 12 months preceding the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.
15. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless ArtBoost AI and its affiliates from claims, liabilities, damages, losses, and reasonable expenses arising from your unlawful use of the Services, your User Content, your violation of these Terms, or your violation of another person's rights or a connected platform's rules.
16. Governing Law
These Terms are governed by the laws of the State of Arkansas, United States, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise. Any mandatory rights available to consumers under applicable law remain unaffected.
17. Changes to These Terms
We may update these Terms as the Services, laws, or third-party requirements change. Revised Terms will be posted on this page with an updated effective date. If a change materially affects your rights, we may provide additional notice when appropriate. Continued use after revised Terms become effective constitutes acceptance to the extent permitted by law.
