ArtBoost AI Terms of Service

These Terms of Service (“Terms”) govern your access to and use of ArtBoost AI (“ArtBoost,” “we,” “us,” or “our”), including our website, mobile applications, integrations, content-generation tools, scheduling and automation features, customer support, and related services (collectively, the “Service”).

By creating an account, purchasing a subscription, connecting a third-party account, or otherwise using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility and Account Responsibility

You must have the legal capacity to enter into these Terms. You are responsible for maintaining accurate account information, safeguarding your credentials, and all activity performed through your account. You may not share credentials in a way that compromises account security or use another person’s account without authorization.

2. The ArtBoost Service

ArtBoost provides tools that may help users connect supported stores and social platforms, organize artwork and product information, generate marketing content, create campaigns, schedule or automate actions, publish or upload content to connected platforms, and analyze service activity. Available features may depend on your plan, device, region, connected platforms, third-party approvals, or technical availability.

3. Connected Third-Party Platforms

When you connect TikTok or another third-party platform, you authorize ArtBoost to use the permissions you approve solely to provide the connected features you select. Third-party platforms are independent services governed by their own terms, policies, content rules, technical requirements, and API restrictions.

You are responsible for ensuring that your content and use of ArtBoost comply with each connected platform’s rules. A third-party platform may modify, restrict, suspend, revoke, or discontinue access to its APIs or your account at any time. ArtBoost does not control those decisions and cannot guarantee continued availability of any third-party integration.

4. TikTok Integration

If you connect TikTok, ArtBoost may use authorized TikTok permissions to identify your connected account, upload eligible content, or publish eligible content to the TikTok account you authorize. ArtBoost will only perform those actions when initiated by you or by an automation or schedule that you configured and authorized. You may disconnect TikTok from ArtBoost or revoke access through TikTok’s controls.

Your use of TikTok-connected features remains subject to TikTok’s own terms, policies, community rules, developer requirements, and any posting or content restrictions TikTok applies.

5. Your Content and Intellectual Property

You retain ownership of artwork, product information, images, videos, text, trademarks, and other content that you submit, import, or provide to the Service (“Your Content”). You grant ArtBoost a limited, non-exclusive license to host, copy, process, transform, transmit, display, and otherwise use Your Content only as reasonably necessary to provide, secure, maintain, and improve the Service or carry out actions you request.

You represent that you have all rights, licenses, permissions, and consents necessary for Your Content and for the actions you instruct ArtBoost to perform. You may not use the Service to infringe copyright, trademark, privacy, publicity, or other rights.

6. AI-Generated and Automated Content

ArtBoost may generate titles, descriptions, captions, hashtags, calls to action, recommendations, images, video concepts, or other AI-assisted output. AI output may be inaccurate, incomplete, duplicative, unsuitable, or similar to content generated for others. You are responsible for reviewing content before using or publishing it and for determining whether it complies with applicable law, platform rules, and your own standards.

When you configure an automation, schedule, or recurring campaign, you authorize the Service to execute the selected actions according to your configuration. You are responsible for reviewing your automation settings and connected accounts.

7. Acceptable Use

You may not use the Service to:

• violate applicable law or third-party platform rules;
• infringe or misappropriate intellectual-property, privacy, publicity, or other rights;
• upload or distribute malware, malicious code, deceptive software, or content designed to compromise systems or accounts;
• attempt unauthorized access, interfere with security controls, probe vulnerabilities without permission, or circumvent usage, billing, or access restrictions;
• misuse third-party APIs, credentials, tokens, accounts, or platform functionality;
• impersonate another person or misrepresent your authority to connect, publish to, or manage an account; or
• use the Service in a manner that materially disrupts ArtBoost, our providers, other users, or connected platforms.

8. Safety, Objectionable Content, Reporting, and Blocking

ArtBoost AI has zero tolerance for objectionable content and abusive behavior. You may not use the Service to create, upload, transmit, publish, automate, or otherwise distribute content that is unlawful, threatening, harassing, hateful, sexually exploitative, deliberately abusive, fraudulent, or otherwise violates these Terms or the rules of a connected platform.

Where ArtBoost displays content or interactions from other users, users may report objectionable content or abusive behavior and may block abusive users. Blocking must remove the blocked user's content from the blocking user's ArtBoost experience immediately where that content is displayed. Reports may be reviewed by ArtBoost, and we may remove content, restrict functionality, suspend accounts, or terminate accounts for violations. We aim to review actionable safety reports within 24 hours.

9. Subscriptions, Billing, and Taxes

Some features require a paid subscription. Prices, billing intervals, plan features, limits, and applicable taxes are shown at purchase or in the Service. Payments may be processed by Stripe or another payment provider. Unless otherwise stated at purchase, subscriptions renew automatically for the selected billing period until canceled.

You may cancel using available billing controls. Cancellation generally stops future renewals but does not retroactively refund amounts already charged, except where required by law or expressly stated in a written refund policy or offer. You are responsible for applicable taxes and charges associated with your purchase.

10. Usage Limits and Third-Party Costs

Plans may include limits on generated content, video generation, storage, connected accounts, scheduled actions, automation frequency, API usage, or other features. We may enforce reasonable technical and usage safeguards designed to protect service reliability, security, provider limits, and costs. Features that rely on paid or rate-limited third-party services may be limited, delayed, or unavailable when provider limits or service conditions apply.

11. Service Changes, Maintenance, and Availability

We may add, modify, suspend, or discontinue features when reasonably necessary for security, legal compliance, provider changes, performance, product development, or operational reasons. We may perform maintenance and may experience outages or delays. We do not guarantee uninterrupted or error-free operation.

12. Suspension and Termination

We may restrict, suspend, or terminate access when we reasonably believe an account violates these Terms, creates security or legal risk, abuses the Service, fails to pay amounts due, or threatens the Service or others. You may stop using the Service at any time and may request account deletion as described in the Privacy Policy.

13. Feedback

If you provide suggestions, ideas, or feedback about ArtBoost, you permit us to use that feedback without restriction or obligation to you, provided we do not publicly attribute confidential feedback to you without permission.

14. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” ARTBOOST DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

ArtBoost does not guarantee sales, revenue, traffic, engagement, reach, ranking, platform approval, account approval, uninterrupted integrations, or any particular business or marketing result.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARTBOOST WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, BUSINESS OPPORTUNITIES, OR INTERRUPTION, ARISING FROM OR RELATED TO THE SERVICE, THIRD-PARTY PLATFORMS, AI OUTPUT, OR THESE TERMS.

Where liability cannot be excluded, ArtBoost’s aggregate liability for claims arising out of or relating to the Service will not exceed the amount you paid to ArtBoost for the Service during the 12 months immediately preceding the event giving rise to the claim, unless applicable law requires a different result.

16. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold ArtBoost harmless from claims, damages, losses, liabilities, and expenses arising from Your Content, your connected accounts, your violation of these Terms, your violation of law or third-party rights, or actions you instruct the Service to perform.

17. Privacy

Our collection and use of personal information is described in the ArtBoost AI Privacy Policy, which is incorporated into these Terms by reference.

18. Changes to These Terms

We may update these Terms to reflect changes to the Service, third-party requirements, security needs, business practices, or applicable law. The updated Terms will display a revised “Last Updated” date. If changes are material, we may provide additional notice through the Service or another reasonable method.

19. General Terms

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent, but we may assign them in connection with a merger, acquisition, financing, reorganization, or transfer of the Service. These Terms, together with the Privacy Policy and any plan-specific terms presented at purchase, constitute the agreement governing your use of the Service.
